I need help understanding a city ordinance:

The owner of all houses, buildings, or properties used for human occupancy, employment, recreation, or other purposes for which toilet facilities may be required, situated within the City and abutting on any street, alley, or right-of-way in which there is now located or may in the future be located a public sanitary or combined sewer of the City, is hereby required at his or her expense to install suitable toilet facilities therein, and to connect such facilities directly with the proper public sewer in accordance with the provisions of this Article within forty-five (45) days after date of official notice to do so, provided that said public sewer is within two hundred (200) feet of the building.


My question: does this ordinance make it so that it is mandatory for a homeowner to extend the main sewer line, install a manhole, and connect to this new extension? I am told that is the case by the city engineer. It will cost us approx $50k and we are trying to find a way around it!

Thank you for all the info! As it turns out, the cities engineer and director of utilities was reading the ordinance incorrectly. We have an email from the deputy city manager stating we would not be required to connect because our property abuts a street that does NOT have a sewer; rather our property abuts a street, that abuts another street with a sewer!

Excellent news for you - from your description I suspected that was the case, and generally if your property is not directly fronted by the sewer (or water for water supply issues) line they cannot require you run your line through other people's property or down street right-of-way to reach the existing termination point.


I would EMPHATICALLY recommend that you ask that city manager to send you a signed and dated copy of his eMail and then scan it to computer and backups, and keep the original where you keep your property purchase records (like safe deposit box) for future ability to pull it out and show them you are in the clear, in case the issue comes up again.


I would let the neighbor you talked to about it have a copy for his files too.


so you can pay attention to the normal details and hassles of a home purchase - hoep you enjoy your new home for many years to come. But in considering possibility of future costs, if they do extend the sewer line into your sstreet, your should assume you may at some time have to pay for abandonment of the septic system (from $1000-5000 typically depending on state/local abandonment requirements) and at least the cost of running a sewer line from your house to the street sewer more or less in front of yoru house - so your are probalby still potentially exposed to a $10,000-20,000 liability risk in buying this house.


BTW - you can find a fair number of previous questions with answers about septic and pump/well systems in the Home >Septic link, under Browse Projects, at lower left. The Well and Pump category there seems to have vanished - may be mixed in with Plumbing.
