Can I back out of a contract if uncommunicative contractor hasn't done or scheduled the work after over 3 months?

I signed a contract to have work done. No timeline was written into the contract, and no deposit was given. Contractor said work would be done 2 months ago at the latest. They have since either ignored my emails or responded saying they are very busy. Can I back out or am I required to use this contractor since I signed a contract?

I presume no work has been done either.


Of course, check out what the cancellation/performance terms are in the contract first.


If no payment has been made, or no timeline was in the contract, it probably is not a valid contract anyway. I would send them a certified return receipt letter cancelling the contract (and send along a xerox with CANCELLED DUE TO NON-PERFORMANCE written across it in red) due to non-performance by the promised date 2 months ago and state the exact date it was supposed to be done (keep a full copy for your files), and see what (if anything) he responds with.


Just in case he objects, I would not get another contractor under contract for a couple of weeks.
