Can my Maryland HOA require me to give a copy of my lease to them and the renter's contact information.?

I own a rental property managed by Victory Management/Aspen Park HOA. Pasadena, MD

Depends on your contract with the HOA and state law. If this is a private property homeowners association which does certain general maintenance like roads but each piece of property is a separate structure on private land (with applicable HOA easements), my impression would be no, assuming you want to be the point of contact with the HOA and you are paying the HOA fees. Letting a renter take your role with a HOA has complications too, especially if they are voting in your place or agree to a fee or assessment or optional improvement that you did not know about.


If this is a condo association or such involving multi-unit buildings, then they have the right (and actually legal responsibility) to have the contact info on the actual tenant for emergency and identification purposes - and in most cases have right of advance review and refusal on lease or sub-lease tenants, like if they do a background check and find out the tenant is a felon or such.


As to a copy of the lease, most condo and apartment and similar type HOA bylaws or contracts provide that the HOA has a right of review and reasonable refusal on leasing or sub-leasing, and commonly also REQUIRES that the lease have specific provisions tying in the HOA rules and bylaws so the renter is also bound by those same rules. Some prohibit leasing/subleasing at all, so you may have gone beyond what is allowed in the bylaws - this may be why they want the info. Check your original purchase/lease agreement for what it says, and contact an attorney if you might have gotten yourself into a bind by not getting prior approval before entering into a lease that, from his viewpoint, your renter will consider valid with you even if it is against the HOA rules.
