Does thermocouple HAVE to be in the flame? Are there thermocouples that don't touch the flame in any water heaters?

Replaced thermocouple, then replaced the Gas valve. same issue. Pilot stays on, heats water, then pilot shuts off completely. I have to keep re-lighting the pilot. I noticed the thermocouple is not directly in the pilot flame.
