Hired a contractor to build retaining wall, begins without approval, refuses to continue after we ask for a change.

Hired a contractor to install block wall. Contractor digs pours footings. Contractor then buys wall block without block approval begins setting wall. I message contractor "which block choice we had" responds "I've already purchased the block" sends me a picture of wall being set. He selected cheapest blocks available. Wanted flat block wall, and expressed this in advance. Arrive to house, upset about blocks. He assures "they'll look great" etc. I relent & agree to continue setting the wall. 1/4 section of one wall set by eve. Aside from blocks crooked, several loose, blocks look terrible. I notify contractor, "changed our minds & want different block." No response. After 24 hrs I disassemble wall, let know we'll eat cost of glued blocks, please return unused blocks, purchase a specific block to cont. Contractor says I've breached contract, refuses continue or refund any of the 9K deposit. On jobsite 5 days. Did I breach contract? Can contractor walk away with 9K legally?
