I think my carpet is moist from lack of moisture barrier between carpet/pad and concrete slab. What do I do?

My carpet feels sticky and I have been advised by friends with proper knowledge and training that it may be due to no moisture barrier between carpet and concrete slab. I peeled a corner of the carpet and pad up and there is indeed nothing between the two. What do I do? Is this a homeowners claim? Is this against a building code?
