I paid my contractor 50% for land prep to build a house, after a year they walked away. How much can he charge me?

The company has been working on getting permits and has done a few site visits. We hit delays with the permit process, they were going to raise prices and we didn't think it was fair. We asked them to meet us halfway for the raise in costs, citing that their team has been directly responsible for the year long delay. They then decided to back out of the deal and no longer work with us. They have spent the last 15 days tracking down "expense reports" to determine how much of the $76k deposit we would get back.

We are not sure if we are going to look for another builder. We will most likely just keep the land as is and not build, so the work they have done up to now has no value to us. Since they are the ones walking away, do I need to pay them for any of the work they have done up to now?
