I would try to get this covered by their new installation warranty.

You don't say how you know the TXV is bad that would be rare for a new unit. But you may have a failed or mis-adjusted TXV, or you may have a leak, a compressor failure, a crudded up evaporator coil, or even a thermostat failure. Be sure the problem is properly diagnosed BEFORE (as some repairmen do) just jumping in and starting to replace parts.
