Who is responsible: the homeowner who says no formaldehyde in the insulation or the carpenter who buys and installs formaldehyde it anyway!

When hiring a carpenter last fall, I made it known that there was to be no insulation with formaldehyde in it used and he agreed. I then discover that he bought(with my money) and installed formaldehyde laced insulation without discussing it with me first and now says it is no big deal. I have written him a letter and he still insists it's nothing to concern myself with. I am WILD! Now, the issue has become one of when I said "NO", it really meant "NO" and not "maybe'. The fact that he did not run it by me tells me now that he put on a good pretense of listening to me, nodding and then doing as he wished and price was not an issue and that was made clear up front. I have called and will meet with my insurance company tomorrow morning in regards to many issues I have had with this particular carpenter regarding honesty, one of which deals with a piece of furniture he liked and was going to work off, instead he entered my home on a non-scheduled day and took it! Is a lawyer next?
