how can i make my neighbor fix their damaged fence which is laying on my property?

My neighbors fence was destroyed and is laying on my property. Can I force them to repair the fence?

What destroyed the fence?

Find a couple of fencing contractors in your area, at , ask them for bids and see if you can get your neighbor to at least split the cost. Good fences make good neighbors. Seriously.

You cannot force them to repair fence unless it was joint property right on the property line, in which case in most states you can sue them to contribute half the cost of repair. OF course, even if you win the suit, you still have to then actually recover the judgement, because our idiot law system does not enforce civil judgements.

If it was on their property, ask them to remove from your property - if they refuse or fail to do so, check state laws on legality of putting it back on their side. I don't imagine you would get into too much trouble if it just magically levitated itself, without unnecessary destruction, onto their side of the line, if their fence. You cannot force them to repair it - they can leave as is (until you file a complaint under local ordinances about eyesores and messy yards), fix it, or remove it as they please if their fence.
